Respected all,
complaint filed u/s 12 of Domstic violence act 2005 by other party. with known falsse information and known false sworn affidavit.
later in Appeal changed interim application also by other party.
we filed 340 CrPC which rejected by trial court.
later filed another 340 CrPC due to change in sitation. which is pending since 6 months.
we filed If Hon. Court record finding and may dismis the complaint. then other party started crying and prayed that my parental property shall be given to her she wanted settle the matter.
Complaint filed with an intention to legalize culpable Homicide and theft in dwelling house. ( she stolen the jewelry of my mother and due to which my mother died some assault also done by her with my mother ).
we prayed Hon. Court to record finding of submitted documents but court except giving dates and threatening us only to give maintenence to her.
court is telling us it is separate matter of the theft of jewelry of my mother and court cannot help in recover the jewelry of my mother for that we shall file separate case.
by every date new date and threatening of distress warrant.
several documents removed from the court record when prayed for certified copy not found in court record.
thus my query may we file appeal u/s 397 of CRPC in session court
please guide and thanks in advance.

section 397 of Cr.PC is regarding revision petition & not Appeal.
