succession rights of a widow in the self earned property of her husband socity

A lady got married in1978, her husband expired in 1982. Her imnlaws strated grzbing al her rghts she was driven out, of the house aquiredby her husband, the .P.F. and otherr benifits like componsetory ground service etc.were tried to be grabed. She fied aciil suit. The case wremained without decision, she bagegged highcourts help and highcourt issued ordered the lowercourt to matrialise the case within one month.
as a result of interim order she was able to get absorbed in her husband's department but the case went on till 2008 and mentining the absent of the Advocate as well her absent the case was dismissed. What shoud she do to get the same for restoration, becaus the deparmental co-oprative housing society is not allowiing her to avail her succesion rights over the plot which is already alloted to her husband and ashing for succesion certificate. Kindly provide the appropriate guidence

Divorce

If husband plans to file case for divorce on the ground of cruelty then what preparations are required before filing the case and what proofs would be required in the court to prove the crelty.

What will be the stand of wife and if she also says that she also want divorce then court will refer for MCD or both will have to contest the case.

These days how much these types of cases take.

Kindly advise.

one claimant to unwilled property missing for more than 7 years

sir,
A father died without making will (for his self acquired property) to his 6 sons and his wife .
how to shre property in the light of
one of the major sons( unmarried) missing since more than 7 years. no paper ad. was given. only informal and general enquiries and searches made. but no avail.he may be surely alive the family feels .
pl. advise if any news paper ad. can be given if so stating what and if property can be shared without any future problem.
what happens if the missing son comes back and claims his share after some time?
pl. advise.

effect of order 23 of Rule 3 of C.P.C

One expert advised to file An application for a decree for dissolution of marriage by mutual consent under section 28 of Special Marriage Act read with Order 23 Rule 3 of C.P.C. / HMA 13

I want to know what is the effect of Order 23 Rule 3 of CPC in connection with Section 28 of Special Marriage Act.

If the portion 'read with Order 23 Rule 3 of CPC/HMA' is not mentioned what is the disadvantage ?

Ancestral Property

Hi,
My father had got so property at North Parur, Ernakulam Distict from my grandfather. Both of the are dead now. My father had given the ancestral property to my mother as gift. Now even my mother is dead. I have 6 brothers and 2 sisters and we all Hindu. All my brothers and sisters ae working out of Kerala. Only my youngest brother was staying with my parents. My mother had made a WILL on this ancestral property and given it to my younger brother. All my brothers and sisters were not at all informed about this ancestral property being gifted to my mother and even my mother making the WILL on my brother name. My mother passed away in January 2007 and my father passed away in 2007. IS there any right that we all brothers and sisters fight for equal right on the property. My younger brother was not willing to show us the WILL. Please advice me.

Cancellaton of sale deed

Respected sir: A person purchased agrcultural land of 4 acres from me for sale consderation amount ofRs:2000000:00(Twenty Lakhs)He paid fifteen lakhs in cash,and for remaining five lakhs he arranged a cheque. The cheque/bank acount belongs to another person (His relatve who is a witness in sale deed document. when I submitted the above said cheque for encashment.It bounced and bank issued endorsement "cheque dishonoured due to insuffcent funds". It is already one month over since I executed sale deed.the amount land valuaton he mentoned in sale deed is six lakhs. Now He denyng he has any due.. Plz advice me how recover my money or land back

Single cheque---shared liability by two ppl ??

I gave training of meditation to one father and her daughter for 30 long days.


Daughter gave me cheque as fees for her father and herself.



Actually this cheque was given for the fees of both of them (Admission form , attendance form was signed by both of them collectively).


Now the cheque bounced.


Should I send notice to both of them or to the daughter only??



How would I be able to involve her father legally as cheque belonged to the daughter only and I can't leave the father because all the docs were signed by both of them collectively as I have already described.
