Notice in consumer complaint

Sir/madam,
My brother in law died due to negligency of the doctor of a govt. hospital. I m going to file a complaint against this medical negligency in the national commission of consumer forum. My ques. are that-
1. Wud i have to make the state govt., central govt., hospital and the doctor as opposite parties in the case?

2. Is it mandatory to issue notice to all of them before filing a complaint and if it is not mandatory, even then should i serve notice to all the opposite parties before filing complaint.

3. How much cud be the amount of claim as my brother in law was in govt. service and his salary was Rs. 90,000/-per month and the govt. is now providing monthly pension to the family that is around half of his salary i.e. Rs. 42000/-.

Please advice.

Challenging an order of the administrative tribunal

Respected Experts,

It is often found that the aggrieved party (Officers in government service) who wants to challenge an unfavourable order issued by an Administrative Tribunal in a service dispute, approach the High Court with an Original Petition (OP) and they get numbered as OP (KAT) or OP (CAT) even though the Administrative Tribunal Act does not specifically provide for any further petition or appeal.

Can anyone among the experts tell me the provision under which such an OP is filed?

Contempt of court

I have a Complaint with regards to a Row House before the Consumer State Commission. In that context, I had obtained a stay from the Commission "Not to sell or create third party rights" from the commission and the OP's were present during the hearing and also gave a verbal undertaking to that effect. No body was occupying the suit premises at that time of stay and neither did the OP's contend to that effect. Few months later, I noticed that the premises was seen to be occupied by a family of 5 (Husband, wife & 3 children). Hence I filed Contempt petition before the Commission for violation of the stay order with photographs and video of the people occupying the suit premises. The OP's firstly took a stand that in their reply to Contempt petition that they do not need anybody's permission to occupy the suit premises. Later, on the date of final arguments they sought time and filed an Affidavit on the next date that the people occupying the premises are the caretakers of the premises. Now my lawyer says that they are protected by the Affidavit and the burden of proof has shifted back on me and I have to bring more evidence or the Contempt petition will be dismissed !
Please guide !
