Security Cheque

I have transferred 5 lac Rs. by NetBanking to seller for products and for security purpose i have taken security cheque of 5 lac Rs from that seller.

My question is :

1) Is only security cheque is safe? (Because later he may cancel cheque, close bank account or present wrong signature etc)

2) Is there any other safe way ?

Cross an handwriting expert

My client working as Jr. Asst in a government office from 2001. Before that he worked as agent for that office.
In 1998, some orders were issued by government for the welfare of some under privileged people. The order is a printed one and the name of the beneficiary, their address and date alone to be written by hand. And it has to be signed by a authorised signatory.

The charge against my client is he issued such forged orders in 1998 (before he joining the duty) to some beneficiaries.
Totally 18 witnesses, four witnesses (beneficiary) say they received the orders from my client, 3 witnesses (agents) also say the same thing. 11 witnesses say not in memory.

Police asked the accused (my client) to sign on white papers as available on the said orders. The accused also duplicated the same signatures (about 50 in numbers) in more than ten plain papers. Police also asked to write the names of the beneficiaries.
Then the police sent the specimen signatures and sample hand writings. The hand writing expert opined that specimen signatures and the disputed signatures matches and No opinion for sample hand writings.

My client/ accd say the police asked to duplicate the disputed signature, so it might have matched.

Now, my question is HOW TO CROSS THE HAND WRITING EXPERT?
Can he opine that just in one day one cannot duplicate another's signature?

Seven witnesses say they got the orders from the accused/ my client. But we have enough ground to cross them.

Trade mark application status objected

I would like to know how to proceed further for registration of the trade mark which has been objected by the registrar of trade mark and what remedies do we have once it has been objected.

The above mentioned application has been examined under the provisions of Trade Mark Act,1999 and Trade Mark Rules,2002 and the trade mark applied for is open to objection under the following sections :

1. The trade marks-which are devoid of any distinctive character, that is to say, not capable of distinguishing the goods or services of one person from those of another person;which consist exclusively of marks or indications which may serve in trade to designate the kind, quality, quantity, intended purpose, values, geographical origin or the time of production of the goods or rendering of the service or other characteristics of the goods or service

2. The Trade Mark application is open to objection on relative grounds of refusal under Section 11 of the Act because the same/similar trade mark(s) is/are already on record of the register for the same or similar goods/services.The detail of same/similar trade marks is enclosed herewith

Save as provided in Sec. 12, a trade mark shall not be registered if, because of-its identity with an earlier trade mark and similarity of goods or services covered by; the trade mark; orits similarity to an earlier trade mark and the identity or similarity of the goods or services covered by the trade mark,

Hence, the above application is liable to be refused. Accordingly, you are

requested to submit your response/submissions, if any, along-with supporting documents, with in One Month from the date of receipt of this Examination Report or you may apply for a hearing.

Please Note that if no reply is received or a request for a hearing is applied for within the above mentioned stipulated time ,the said application shall be treated to have been abandoned for lack of prosecution under Section 132 of the Trade Marks Act,1999 and there after the status of application in the computer database shall reflect the factual position

Co-operative Housing Societies banned bachelors

My brother facing this issue.
Can co-operative housing societies refuse tenants because they are student or bachlor?

audio/video tape

Dear sirs
You all are kindly requested to please suggest me either a videotape can be a evidence,in which the witness has accepted that he has not seen you on crime site.
whereas in court he says that you are guilty.
Can a person escape by providing these audio/video clips in court

Does traffic challan under mva 129/177(driving with out helmet) will effect my police verification

dear sir i have been selected in public sector bank... they asked me a declaration form in that i have to declare whether i have any pending case in court or if i ever been convicted by court of law.... dear sir once i have been caught by traffic police for driving without helmet and i have paid spot traffic challan of rs. 200 .... now i am confused that what should i write in declaration... and does this traffic challan under MVA 129/177 {driving without helmet} will effect my police verification what should i do know... please guide me

recently I have been selected to a govt. job of PSB(public sector bank) ... i want to know that whether traffic challan for driving without helmet under MVA 129/177 will effect my police verification... does i will be cleared by police for the job...

Please intimate whether it is illegal in India to record telephone conversation of a person without his knowledge.

Care taker

I have purchase one land in ABCD town . But due to disturb of broker, I have kept two CARE TAKER who is staying there around 10.0year.I have not signed any document regarding this issue . When I have asked then to vacate the land the caretaker refused to vacate the land and making some false statement that that I have promise them that I will provide them shelter for life long . Please let me know that
1) Whether they cam claim land
2) Whether they can claim unskilled lab our rate last ten year in the name that they have protected the land
How can I protect the land so that care taker can not claim the ownership of the land

2 pan cards

I have 2 PAN nos. While I have been using only one for all my tax/other purposes since 8-10 years. But there were some IT returns filed under both earlier to that. Now when I applied for re-issue of PAN, IT department has sent a letter asking for justification. The other card was not surrendered as I was not using it anyway.

What can be done now?
