Consumer Court

Recently i ordered a cricket bat priced Rs 9000 at flipcart . I want to gift this to my team mate. So i ordered this at his address. But when he received the bat this was not the same as described in flipcart ad. So i asked flipcart to replace it. But flipcart did not deliver the genuine product which was promised in its ad.then i write to flipcart through its 'need help ' option , but flipcart took no action. I complain to consumer help number. They provide me a docket number and asked me to let know the flipcart about this docket number. I used the same 'Need help' option at flipcart and add the details. After two days i received a call from flipcart and they offered me to have refund. But i said i need the bat u promised. I am at Dhemaji district. And the seller is from Meerut. I want to complain to consumer court. Please guide me . Where should i complain and what is the procedure?

Joint ownership of our flat

I and my wife purchased a government flat in my wife's name sharing the purchase amount equally. Now my wife is already trying to dominate me and this may lead to divorce.

Prior to that I want a equal ownership in the flat as both have paid equal amount while purchasing the flat.

Kindly let me know the procedure for the same.

Right to information act

Sir,

I had purchased the flat in 2001 at Pune. and the agreement was registered on 2001. Now the original copy of the said agreement has been misplaced but xerox copy of the same is with me. For taking Original copy, May i apply under Right to information Act for receiving the original copy ? if yes so which authority or CPIO will entertain this application.

Please let me know asap. itz urgent for me.

Stamp duty on sale deed in surat, gujarat

I am Purchasing a property in Surat from a Bank under the SARFAESI Act in my wifes name.
I have been told that i will have to pay the Double Amount of Stamp Duty to get the Sale Certificate Registered.
The registrar considers one transfer of Borrower with Bank and the secont transfer with Bank and me.
I am also told that the registrar has the right not to levy chartges of 2 times Stamp duty.
Need clarification on the actual charges and weather the sub registrar has rights to charge less

Hello Experts,

I am an Advocate from Hyderabad. I have a query.
I have filed a case in consumer forum against a Hotel in Hyderabad for deficiency in service and the case is in the argument stage. And the Hotel have filed their chief evidence and the person deposed the evidence has stated him as the authorized representative of the Hotel.
But the authorization letter filed by the hotel in the court has a different name, instead of the name of the person deposing the evidence.
Now the question is When a firm, company, or a body corporate is made as a party to the suit it appoints an authorized representative to follow up the cases in the court and even the companies give authorization letter to the authorized representative.
Now my query is as far i know only the authorized representative has all the right to represent in the court.

How far is it correct?

I only want some of the Citation of the Apex Court or any High Court.

Plz suggest me.

Summary suit

Hi. I want to file a civil summary suit who failed to pay up the consideration agreed by them for the fulfillment of my part of the contract. Wanted to inquire the following:

1. In the matter above mentioned, can i file a summary suit.

2. If yes how do I go about.

3. Who would send the summons to the other party in this case.

ancestors property gift deed

I will explain my case my grandfather died without any will so as elder son my father took hold on property. My father has 2 brothers and 1 sister now my father says his sister has given hakka sod patra so now 3 my father and 2 brothers are there as this property is ancestral can my father gift deed any of the part to this property to only one son as my father has 2 sons And1 daughter? Under what circumstances my father can gift deed property?does he have authority to gift deed ?do i have right on ancestral property? My father and his brothers has made vatahukumnama so now still the property is ancestral?

Property civil suit

I had a signed sale agreement with a buyer. Buyer started creating problem in giving money by making excuses. Buyer did not make any payment by the due dates specified in the agreement. So finally I gave notice and cancelled the agreement and forfeited the deposit. The contract clearly stated that if the buyer defaults then the money is forfeited.

After 3 years of the sale agreement date I transferred the property to my relative via gift deed. There was no stay on the property and no law suit pending.

Now I am getting information that the buyer is filing a law suit specific performance and for money recovery.

Can the buyer get a stay on the property which I don't own anymore?
Does specific performance work if I don't own that property anymore?

What can the buyer claim in this situation?

Civil suit or consumer suit

My vehicle company, FIAT failed to provide me services for last 10 months and they regularly mislead me that their workshop which was due to some reason closed in entire north east region will be ready in 10-15 days, whenever I communicated. After 10 months, however the workshop is ready last week and now I will be taking the vehicle to them, immediately. My vehicle actually met an accident on 18.08.2014 and it suffered certain damages and was immobile during the last ten months and I could not avail it services and had to make arrangement of place to store it. And due to such long period of idleness, since it was a diesel vehicle, its engine and other machinery has already suffered many damages. I have also suffered professionally and financially for it. FIAT doesn't seem to provide me any assistance towards even providing parts damaged due to corrosion. What should I file against them for asking compensation for the losses I incurred? I have records of hundreds of emails I sent to them as well as the acknowledgement card of postal notices I sent to them.

Is it a Civil suit or consumer court case!
