Salary half giving after resignation.

Sir,
Our 6- minths contract ending in jul-21016 then extension contract ending oct-2016. Then we not accepting another extension letter and company not forced us. Then we resigned nov-2016. But they given half month salary in mid feb-2017 after long period. Also they not cleared, salary slip from august-2016, no clearns about PF. So please suggest what we do.

Apparently you are Fix Term Contract (FTC).
Was it FTC?

If contract was ended and extension was communicated by company and you did not accept extension, then what was the need to resign?

Did you work for any day after expiry of contract in Oct, 2016?
Was there any T&C of notice period/pay in contract?
On which date/month/year Company communicated extension of contract to you?
What was your designation and nature of duties?
You were in which state?
Who is employer: Govt/Private?


Do you have copy of service rules applicable to you?


Have you communicated in writing under proper acknowledgment to employer and do you have copies, proof of dispatch, delivery?


Are you member of any employee’s/trade unions?


How many employees like you are involved and affected?

Sir, we did work after expiry of extension contract ending in oct-2016. In extension contract letter no term and conditions. But in jan-2016 we got appointment letter there is one month notice period. Aftet ending our sixth month contract in jul-2016. We get extension contract letter in oct-2016. And after we not accepting another 3 month extension contract letter. My designation Sr. Gis executive duties is information technology computer designed. State Maharashtra Mumbai employer is private this consultancy situated in harayana gurgaon. Also they open PF account in haryana instead of Mumbai. We getting UAN no but on site this UAN not registered problem. We coomunicated via mail with 5 days time. No hard copy dispatch yet . we are not trade union member and we have 25 people affected 22 gents and 3 ladies

Dear Ashish,
You have problem in communication/ presentation of your case.
Go to a local lawyer in person along with all relevant papers and get his advice.

Apparently company has squared off dues by applying deduction of Notice pay, but is unwilling to provide any document for it.



Write under proper acknowledgment to contractor/Principle employer to supply;

acknowledged bearing seal with date of notice of resignation/final resignation submitted by you, its acceptance, salary slips of all months, correct FnF statement (showing; attendance in the month, earned wages, bonus, leave encashment etc etc as applicable and deduction e.g; PF,ESIC, TDS and even notice pay), FnF payout say by bank DD, Form 16 as per correct FnF statement, PF number and a/c slips/passbook as applicable, ESIC card, acknowledgment of handover of charge/assets if any, service certificate, relieving letter, NOC/NDC etc etc
