Reg: name on passport

(Querist) 29 September 2014 This query is : Resolved
Respected Experts,

I have a query Regarding my name on my passport. I had an inter religion marriage under special marriage act and also a nikhanama. I am Hindu and my husband is muslim.
After marriage I have continued my hindu name on all my legal documents including passport. Officially I have not taken my muslim name as it was for nikhanama purpose only.
Now I plan to shift to Dubai(UAE) with my husband. I need to know will I have any problems with the laws there if I use my hindu name as I have heard shariat laws apply there.
Please help..as I really need some good expert advice on how to go about it.I would not like to change my change and I am looking for solution as how to keep it.

Thanks & Best Regards
Preeti

u have your right to maintain your maiden name and your marriage with a muslim does not mean u need to become a muslim that way you married and that way you say u follow hindu laws no one can force you to become a muslim just because u married a muslim.

AS u continue to be a hindu he cannot foist on you muslim laws, that way is created special marriages act.

so your marriage certificate you obtain in india should clearly show your name in hindu way and your husband in muslim way.

Marriage does not go by religions but just by liking the other that is all.

None can force you to change your religion unless you love to change,

so u can follow your religious ways too in your worship, so too but both need to follow secular laws of marriage terms

Ofcourse Shariat does not recognize inter religious marriage as any other personal law like Hindu Law, Christian law, Parsi law etc. But as u are married under the Special marriage Act u are entitled to be governed by it. U need not change ur religion or name.If any query is raised in Dubai u may show ur Special Marriage certificate.Carry a copy of the ACt with u.

You have a valid marriage certificate under special marriage act, this will suffice your requirement. You do not have to change your name in the passport, you can go ahead with the same name. There is no compulsion that aw has to change her name after marriage.
