Private terrace area in a flat Viz a Viz UDS conveyance

My uncle who was the original owner of the land in Bangalore entered into a JD agreement with a builder 10 years back. The builder has not conveyed the UDS in full though he does not own a flat in the complex. Now he agrees to convey the balance to all proportionate to their built up area. One owner who has a private terrace in the top floor claims that he should get more UDS share for the private terrace area also which is an exclusive right of usage given to him by the builder. Is he right in claiming the UDS proportionate to the private terrace area also? The property is in Bangalore. Please clarify whether any law or write up is there to show him that he cannot claim.
