Parking issues in housing societies

(Querist) 02 December 2015 This query is : Resolved
would like to know if the supreme court judgement on parking issues in co-operative housing societies is applicable for societies formed in 1979? there are few members who claimed to have purchased stilt parking space from the developer by registering an agreement. is this valid? they are now demanding that they need unrestricted drive way leading to the stilt parking and no cars should be parked which would create inconvenience to them.

What is wrong in their demand?

What is your case?

there are couple of points here. there are few open parking space available in the society where people who does not have stilt parking space park their vehicle. since it is a small society one of the member insists that his car should come straight to the compound and then take a u turn in the compound and then enter his stilt parking. the place where he takes u turn is an open car parking space which he is objecting. further he is insisting that place should be left vacant and whatever open space is available should be on rotation so that one place always remain vacant and also he has an office near that open space as well where he does not want car to be parked. if we have to adopt rotation policy, then should we consider the stilt parking space also as available for rotation?
