Pagdi system

Dear Sir

I am a 25 years of age boy staying with my mom dad in andheri pagdi system house which belonged to my grany.5 MONTHS AGO MY grany expired and now my dad elder brothers wife is asking forthe share in the property.She was staying with us till january 2015 and then shifted to a rented house in Mira road. The Landlord is asking for NOC from all brothers and sisters.Then only he can put the rent receipt in my dads name.
I cannot sell or leave the house as my dad is retired and i work alone and run my house.what are the chances can they force me legally to leave the house and how do i make the receipt on my dads name wherein i am paying the rent from last 5 months after grany.

Paying the rent alone will not protect your rights or interests. In fact you don't have right or interest in the property while your father is alive. Therefore you may convince your aunty to come for a compromise by taking some money as her share and give NOC to your father after which you can get the transfer on your father's name.

How long this thingh can continue that the rent receipt is still on my grany name even after her death.Can anyone the Lanlord or my dad brother sisters force me to leave the house.

1.Can i have any other solution for this because the amount offered by my dad to dad elder brother wife is not agreed by her.
2. should we remove her name from ration card will this help.
3. wheather she come back and stay with us and if she comes will this go against us.

1) The legal solution is to get NOC from all other heirs of your grandmother in your father's favor and get the tenancy changed to his name.
The amount asked by her or your father's elder brother have to be negotiated to the possible level and compromise the issue or else no one will be benefited,the landlord will snatch away the property from your people.


2) That will not help you to remove her name from the legal heirship list. Dont try that gimmick, you will be at fault and held liable for the consequences.


3) Yes naturally. If she decides to stay back, this will cause you more troubles.

1. Actually only one hierer which is my dad elder brothers wife who use to stay with us is interested in the property money.
2 We wanted to get this propery to be in two name one my father and one elder brother wife name(Joint name).As we have two main doors of flat.But the landlord says the property cannot be in two names it can be only in one name.So is he right as per law we cannot transfer in two names?

3. Does landlord has the right to snatch the property from us even if we are paying the rent on time if we dont give the NOC .How long he can give the rent receipt in my grany name ?
without transfering in any other persond name.There must be some criteria for this saying so many months he can wait for NOC and then transfer the name.
