House hight increased

I have a house in mumbai in pagadhi system which is below the ground level due to which i face lots of trouble in monsoon.
Our house is G+1 and we are located in G. The person located on 1st floor was made some settelment with the landlord and left the place 15years ago and the same is empty for which BMC has removed upper part of the House (Patra) hence we face more difficulties.

Kindly let us know the process to raise the height of the house and what shuld be done of 1st floor.

You can go for an injunction suit and if such norms are not available then chose a Writ Petition before Delhi High Courts.
