While considering the custody of the child, we all know that paramount consideration is the welfare of the Child. But this welfare of the child does not mean that it is the right of the Mother to have the custody: The court can not look at the matter with a Nelson's eye on the Mother only: What is to be considered is who will be fit to have the custody of the child and not as a matter of right for the Mother. After all relevant aspects of the Mother her character,her position to look after the welfare of the child, her income etc; has to be considered and not as a metter of right.
