Do you know what a cartel means? Can you figure out an effective way to reduce risks of being affected by a cartel?

Can all your vendors enter into an agreement to exclusively sell your rival company's products? What can you do about it?

Can you advice an offshore company on competition which is contemplating entry in India?

In June 2017, a company as huge as Hyundai could not save itself from a fine of Rs. 87 Crores for anti-competitive practices. Competition law is undoubtedly one of the most technical fields of law, however, it is not really welcomed by a lot of companies. The primary reason for this is the heavy penalties that the Competition Commission does not shy from imposing.

Competition law has become an integral aspect while entering into any deal. Right from regular contracts to huge corporate restructuring deals, competition law is one area that cannot be neglected.

What makes competition law extremely technical is the market research required to ensure that any law is not being violated through any agreement by the corresponding parties. The economics of the market is an added burden while evaluating any such deal.

What can you do to prevent your company from anti-competitive behaviour?

Anti-competitive behaviour has been prevalent in the Indian commercial ecosystem for a while. Certain steps need to be followed to ensure that the business is protected from such behaviour. Just being vigilant won't suffice. There needs to be a thorough market report that needs to be created which can conclusively point out a anti-competitive activity and subsequently be filed at Competition Commission of India.

It is a time consuming process and it involves a lot of metrics. You need to ensure that you are well acquainted with the law. Cartels, vertical and horizontal agreements, and abuse of dominant position are some of the key issues that can affect your business in the long run.

What do law schools teach?

Strangely, law schools in India focus on competition law in a very restricted fashion. A very limited perspective on the competition law in India coupled with the case studies of some famous cases such as the T-Series Case on Abuse of Dominant Position, UltraTech Cement Cartel is the standard course syllabus in law schools in India. In fact, some of the state law colleges haven't been able to introduce competition law as a subject into their syllabus.

With absolutely no focus on comparative studies of the competition law in India vis-a-vis the laws in United States, or the European Union, students are barely armed with pre-requisite knowledge that is required to deal with the cross-border nature of issues and disputes that are quite frequent in this field of law.

If asked, will you be able to advise a company from Mauritius who is planning to set an offshore business in India?

A global perspective on competition law is extremely important. In case you are advising a client on the cross border arrangement, you need to ensure that you have the understanding of the prevalent laws to compare and comprehend for better correlation.

To help you overcome this issue, LawSikho, an initiative of iPleaders, has come up with an Online Certificate Course in Competition Law, Practice and Enforcement.
