Jurisdiction of court

Respected Sir/Madam, My wife has lost her memory completely, she is physically and mentally abnormal due to the side effect after outcome of suicide attempt. Now she is living with her parents. My in-laws filed a case against me u/s 498(A), case is under trail in court. All this happens in 2013. They kept My twins girl childs from 2013 to for 2017. In May 2017 they sent my childs to my custody. I admited them in prestigious school by giving huge donation. But on 28. 04.2018 they suddenly kidnaped my childs without my knowledge from my residence in Bangalore city . Now they are with my in laws outside the city. I gave complaint to police but they simply regd NCR and closed the case.

I approached my lawyer to file child custody case in family court of Bangalore. But he told that since they r living outside the city I should file case in family court where my childs stays which is 50 km from my residence.

Is there any provision to file case in bangalore city since they taken my childs from my residence in Bangalore?

In any Family Court matters the Priority and Preference would be only to the Wife and mother.

No Child Custody could be given to a Father Unless and until the Children are major and maximum you could claim Visits Legally and thro Courts only.

There is no Legal word as Mental Abnormal. In this modern world each and every one would have some Psychological Problems due to Stress and Strain etc for that reason they can not be Certified as Mentally retarded.

Respected NJSR Sir, my wife involved in some un lawful activiities(to obtain false Certificates like Income certificate, Physically Handicap certificte etc., Which are proved and in some cases charge sheets were filed in court against in laws and my wife). After coming to know that, these unlawful activities are done by my wife colluding with her parents, I am being an Govt. Servant immediately started questioning about her illegal acts, she tried to commit suicide by hanging herself. I immediately with the help of neighbours broke open the door and rescued my wife and admitted her to Hospital. I borne all the expenses to the tune of Rs.5 lakhs. But hiding all these facts my in-laws filed a complaint in Police Station and the case is filed u/s 498(A), 307 IPC. While submitting charge sheet to the court (ACMM Court, Bangalore) Police authorities dropped the 307 IPC based on facts mentioned in Medical Certificate and they submitted Charge sheet u/s 498(A), 504, 506 only.

Try by meeting Higher officials in person and pursue by RTI...
Let the police reply to you if complaint is transferred to another PS or whatever else..

Try by meeting higher police officials in person and pursue by RTI. Let the police reply to you if the complaint
is transferred to another police station.
