Water seepage from top floor

(Querist) 09 May 2024 This query is : Resolved
Water seeps into the ceiling of my kitchen, bathroom and bedroom ceiling. The owner of the flat above mine is not doing anything to fix this seepage. Association is not helping me in getting the leakage fixed. What can I do?
T. Kalaiselvan, Advocate (Expert) 09 May 2024
If the neighbor above your flat is not cooperating or listening to your plights in this regard, you my resort to legal action by first issuing a legal notice demanding him to rectify the issue and to stop further damage to your proeprty.
If there is no response then you have the options either to approach the local civic body with a complaint or to approach the local civil court with a suit for mandatory injunction to direct him to rectify the damages and suitably compensate you for the damages suffered by yo so far in this regard
P. Venu (Expert) 10 May 2024
Yes you may issue a legal Notice and follow up with a civil action, if so advised.

You also have the option of placing the matter before the Adalat functioning under the Taluka/ District Legal Service Authority.

Yes. And if the association is not taking any action, you may complain it to the Dy./Jt. Registrar of Cooperative housing societies of your district.
Sudhir Kumar, Advocate (Expert) 12 May 2024
You have not shared if it is cooperative society/ builder flat / housein board etc.

Neither Association nor the flat owner will listen to you as long as they can conveniently afford to ignore you.

you have to file suit. You can also complaint to the SDM for abatement of nuisance.
