Redevelopment of society building



We have more than 80% written concent duly signed by the society members for redevelopment. As few members are working abroad or out of the state their physical presence in the SGM is not possible. Therefore 75% attendence in the SGM is not possible. Is it mandatory that they must be present in the SGM? Can we place their written concent in the SGM and add them in the majority in their absence and proceed with SGM? Is the decision taken by the members present in the SGM in this regard will be valid and treated as legal in the court of law? Our building is 35 years old and lot of leakages both externally and internally. Structural Audit Report is awaited.

PLEASE GUIDE.

First class magistrate in madhya pradesh

I need an affidavit attested by first class magistrate for non judicial purpose . Who are the officers as First Class Magistrate in Madhya Pradesh who have the jurisdiction to attest the affidavit? Is the District Magistrate or SDM authorized?

The question appears to be academic. Can Company C create valid equitable transaction, legally yes, subject to certain conditions. But the question is better answered by the bank according to it's credit policy. Let Company C (if it really exists) approach intended bank and get Bank's opinion.

Will by elder sister to his minor brother

A valid WILL mus contain clear description of

1. Person making will
2. Person in whose favour will is.
3. Religion of both.
4. Free will.
5. Sound capacity of mind of the person making will
6. Lack of influence or coercion on the person making will.
7. Clear description of property.
8. Clear description of the conditions.
9. Clear date.
10. Clear identity of the witnesses.

Succession rules pagari system for redevelopment

Even though your step brother was living with your father at the time of his death, since this is a pagdi system property, in order to acquire the property during redevelopment all by himself, your step brother need to obtain NOC from all the legal heir of the deceased tenant i.e., your father.

If the elder sister is having a clear marketable title to the property she desires to bequeath in favor of her younger minor brother, she can very well proceed doing so, but she has to name a guardian to take care of the interest of the minor beneficiary during the period of his minority if the Will shall become enforceable

If she has not converted to Muslim after her marriage then she can very well retain her community status and can enjoy the privileges available to her caste without any restrictions.
