Human rights are often referred to as fundamental rights... Why? And what exactly are human rights if you need to explain them to a child in simple words...

Human Beings are born in dignity and rights... Hence, according to me Human Rights can be described as those morel claims which are inalienable and inherent to all individuals by virtue of their humanity alone... i.e. irrespective of their caste, colour, creed, and place of birth, s*x or culture. These claims are articulated and formulated in what is know as “Human Right”. These are the rights relating to life , equality and dignity of the individual guaranteed by the constitution or embodied in the international covenants and are enforceable by courts in India. These rights can also be referred to as basic right, fundamental rights or birth rights etc. In my opinion these rights are inalienable and are conferred on an individual due to the very nature of his existence. They are inherent in all individual irrespective of their religion, caste, creed, s*x and nationality. Human Rights in my opinion are essential and necessary for the very existence of an individual. In the absence of human rights the moral, physical, social and spiritual welfare of an individual is next to impossible. They are actually essential as they provide suitable conditions for material and moral upliftment and proper survival of an individual. These rights are actually in connection with human dignity...As to treat another individual with dignity irrespective of the fact that the person is male or female or what his social status is, etc. These rights are irrevocable. They cannot be taken away by any power or authority because these rights originate with the social nature of individuals in the society and they belong to a person simply because he/she is a human being. These rights are necessary for the fulfilment of the purpose of life. No government has or should have the power to curtail or take away these rights which are sacrosanct and immutable. Human rights are actually universal i.e. they are not just for a certain fixed section of society but are actually for all. Values such as divinity, dignity and equality which form the basis of these rights are inherent in human nature. Nonetheless, Human rights are never absolute. Human rights as such are contributory to the common good and are the those which are recognised and guaranteed by the state, through its law to the individuals and these are dynamic in nature which implies that every individual has legitimate claim upon his/her society for certain freedom and perks to ensure his/her dignified existence.

what is human rights ? 

human rights are rights and freedom of every person  from their birth until their death  . Human rights are rights inherent to all human beings, whatever our nationality, place of residence, s*x, national or ethnic origin, colour, religion, language, or any other status. We are all equally entitled to our human rights without discrimination. These rights are all interrelated, interdependent and indivisible.

 

There are a variety of human rights, which including

  1. Right to equality
  2. Right to freedom
  3. Right against exploitation
  4. Right to freedom of religion
  5. Right to education
  6. Prohibition of discrimination on grounds of religion, race, caste, s*x or place of birth

 

Above mentioned human rights are also included in fundamental right so human right are often mentioned as fundamental rights

Now we will go through fundamental rights so that we can clearly understand what human rights basically are

 

  1. Right to Equality

Right to Equality ensures equal rights for all the citizens. The Right to Equality prohibits inequality  on the basis of caste, religion, place of birth, race, or gender. It also ensures equality of opportunity in matters of public employment and prevents the State from discriminating against anyone in matters of employment on the grounds only of religion, race, caste, s*x, and descent, place of birth, place of residence or any of them.

2. Right to Freedom

Right to freedom provides us with various rights. These rights are freedom of speech, freedom of expression, freedom of assembly without arms, freedom of movement throughout the territory of our country, freedom of association, freedom to practice any profession, freedom to reside in any part of the country. However, these rights have their own restrictions.

3. Right against Exploitation

Right against Exploitation condemns human trafficking, child labor, forced labor making it an offense punishable by law, and also prohibit any act of compelling a person to work without wages where he was legally entitled not to work or to receive remuneration for it

4. Right to Freedom of Religion

Right to Freedom of Religion guarantees religious freedom and ensures secular states in India. The Constitutions says that the States should treat all religions equally and impartially and that no state has an official religion. It also guarantees all people the freedom of conscience and the right to preach practice and propagate any religion of their choice. 

5. Cultural and Educational Rights

Cultural and Educational Rights protects the rights of cultural, religious and linguistic minorities by enabling them to conserve their heritage and protecting them against discrimination. Educational rights ensure education for everyone irrespective of their caste, gender, religion, etc. 

6. Right to Constitutional Remedies

Right to Constitutional Remedies ensures citizen to go to the supreme court of india to ask for enforcement or protection against violation of their fundamental rights. The Supreme Court has the jurisdiction to enforce the Fundamental Rights even against private bodies, and in case of any violation, award compensation as well to the affected individual.

The post is interesting. The content explores Human rights. There are many Human rights laws and knowing these laws will help you one way or another. Human rights consist of the right to life and freedom, liberty from slavery and torment, freedom of opinion and expression, the right to work and education, etc. Everyone is unrestricted to these rights, exclusive of bias. Human rights are the fundamental rights and freedom that is given to every citizen from birth until death.

In simple terms, the rights guaranteed by the constitution of India are known as Fundamental rights. There are six fundamental rights in India which are the basic human rights for all citizens irrespective of their gender, caste, religion etc. The term democracy means that the government works for the people and gets its authority from the will of the people. The supreme court recognizes fundamental rights as Human rights. The Protection of Human Rights Act, 1993 defines Human rights as the rights relating to life, liberty, equality, dignity etc. Human rights are very important as they contribute to the development of the country.

No part of law is out of domain of human rights.

 

Fundamental rights just manifest and protect some human rights.  A few of them are restricted to Nationals and others available to foreigners and some available even of illegal entrants.
