Past regular service on macp pay upgradation

I have worked in a central govt. autonomous instistution from 28/12/2010 to 14/09/2015, then I joined another central govt autonomous institution near my home town through technical resignation, without having any break in regular service. On 28/12/2020, I completed 10 years of service, but my current institution denied the first MACP pay upgradation on 10 years. As per Technical resignation OM, the resignation is only for technical formality, the service will be continued without any break. In my case I am working on the same grade pay for 10 years, am I eligible for the first MACP? Kindly provide your expert opinion

Whether CCS (CCA) Rules apply to both the organisations ? If so, you are eligible for MACP.

Refer to Government of India, Ministry of Personnel, Public Grievances and Pensions, (Department of Personnel & Training) Establishment (D), North Block, New Delhi, Dated: 4th October, 2012 regarding  Modified Assured Career Progression Scheme for the Central Government Civilian Employees —

Yes, both central govt. institutions are governed by CCS rule and come under the ministry of health and family welfare. As per DOPT guidelines past continuous regular service in another Govt. Deptt. in a post carrying same grade pay prior to regular appointment in a new Deptt. without a break shall be counted towards qualifying regular service for the purpose of MACPS. Even though accepted my technical resignation, and was granted pay fixation, I cannot convince my current administration, but they are not ready to deny it in writing and asked me to produce relevant documents to support my request for MACP.

You are entitled for grant of MACP. Make a representation or an appeal in terms of CCS(CCA) Rules. If no positive results, approach the Central Administrative Tribunal.

thank you for your reply, i have given representation with supporting dopt circulars and last one and half year I am following up, now grievance committee is verifying my appeal. From my institution No one giving clear answer on writing whether accepted or denied.

Move to jurisdictional CAT assailing in-action of the department, through a local prudent lawyer practicing service matters,

Follow up or repeated representations are of no avail. As already advised, you should take steps to file an OA in the CAT.

Hello everyone

We are working in an autonomous central government institute. Same scenario is happening with us. Here,I would  like to give details of mine and my senior's service tenure:

1.One of my senior joined as a staff nurse in the year 1997 and got  her 1st  ACP ( 4600 to 4800) in the year 2007, thereafter through direct recruitment after technical resignantion, she  joined the post of Public Health Nursing Officer ( PHNO) in the year 2010 ( grade pay 4800) at the same institute. My query is if she was entitled to 2nd MACP in the year 2017. But my institute has given her " 1st MACP" in the year 2020 for the new post she is holding at present.

2. Regarding my own case details are:   

Date of joining : 22.10.2002 ( Staff nurse, Grade pay 4600)

1st ACP : 22.10.2012 (Grade pay 4800)

Joined new post (PHNO) : 01.07.2016 (Grade pay 4800, through direct recruitment in the same institute)

Dear Sir,

I have joined a Central Govt organisation on 01-May-1987 in the slace of 1200-30-1320 (Grade pay2400)

Got ACP of gradepay 4200  in Aug 1999.

in 2007, Selected for a post of GP 4200 under direct recruitment and Technically resigned and joined the new post with the same gradepay

Since then no promotion. but I was in same grade pay 4200 from 1999 to 2015.

When do I get the next MACP

It is better to post afresh query in new thread as it has mixed up facts pertaining to a queriest with another, wherein circumstances are neither same nor similar.

PFA service detail of mine: 

-- Date of joining as sister gd II  ( Central govt health institute): 22.10.2002, grade pay 4600

- -Got 1st MACP: 22.10.2012 ( gr pay 4800)

--I have submitted technical resignation in 2016, to join post of Public Health Nursing Officer ( PHNO direct recruitment, in the same institute) grade pay 4800

-- I am going to complete my 10 years in same grade pay (4800)on 22.10.2022

-- My institute is refusing to give me 2nd MACP, which is due on 22.10.2022 stating that I am eligible to get the same in 2026, from the date of my last joining as PHNO in the year 2016.

Kindly provide your expert opinion in the same matter, when i am eligible to get my 2nd MACP in 2022 or 2026.

Is my past service from 1987 to 2007 counted for MACPs ?
