Civil case against trespasser

I AM OWNER OF PROPERTY TRHOUGH NOTARY PAPERS AND SOMEONE HAS ILLEGALY TRESPASSED MY PROPERTY IN FIR HE HAD BEEN CHARGESHEETED UNDER SECTION 420 /448/34 OF IPC..........................................BUT MY SPECIFIC QUESTION IS TO GET POSESSION WHICH CIVIL SUIT I COULD FILE.....ANY SPECIFIC SECTION OR SIMPLE SUIT FOR POSESSION IS ALSO MAINTENABLE

आप कानूनी दृष्टि से अपनी संपत्ति के स्वामी हैं ऐसी स्थिति में जब कोई जबरदस्ती आपकी संपत्ति पर घुसता है या घुसने की कोशिश करता है उस पर अपना कब्जा जमा ता है और वहां बना रहता है जान से मारने की धमकियां भी देता  है तो आप आईपीसी की धारा 34 120b 323 325 456 504 509 मुकदमा दर्ज करा सकते हैं परंतु सिविल प्रक्रिया के अंतर्गत आपको डिक्लेरेशन सूट फाइल करने की आवश्यकता नहीं है केवल आप परमानेंट इंजंक्शन के लिए  Order 39 Rule 1 & 2 का वाद ला सकते हैं फिर बाद में आपको उसके खिलाफ परमानेंट इंजंक्शन मिल जाएगा और उसके बाद यदि वह फिर भी आपकी संपत्ति में घुसने का प्रयास करता है तो यह कोर्ट की अवमानना होगी वहां आवेदन करने पर कानूनी मुकदमा चला कर जेल भेजा जा सकता है इससे अधिक कुछ भी करने की आवश्यकता नहीं l अधिक जानकारी के लिए आप मुझसे 9760290825 पर ऑनलाइन कंसल्टेशन चार्जेस तय करने के बाद संपर्क कर सकते हैं

Hello,

You can file suit for possession against the trespasser. You have already filed the criminal case and FIR is registered so it will help you in the civil suit. You can directly move court by praying urgent relief.

The facts posted are too sketchy and suggests you are seeking suggestion for a transaction which is deficit in legitimancy!

Section 6 of the Specific Relief Act, 1963 which stipulates:

6. Suit by person dispossessed of immovable property.—(1) If any person is dispossessed without his consent of immovable property otherwise than in due course of law, he or any person

(2) No suit under this section shall be brought— (a) after the expiry of six months from the date of dispossession; or (b) against the Government.

(3) No appeal shall lie from any order or decree passed in any suit instituted under this section, nor shall any review of any such order or decree be allowed.

(4) Nothing in this section shall bar any person from suing to establish his title to such property and to recover possession thereof.

I concr with the experts. In such a case better to use both Civil and Criminal Law in motion rather that a shotgun.
