Medical reason underage kid driving 2 wheeler can a off duty police man catch him.

Can a constable police, not traffic police, who is not on duty, can he catch under age children driving two wheeler, hit them and threaten their parents? What action can be taken against him?
If that child was caught going to medical store to get some medicine for his father who is not well. Can he go to get medicine?

um no the police should not catch him its not his duty. if people want they can easily catch police officers giving bribes but they don't.

Merely because someone is a cop that does not mean that he cannot make a complaint to the authorities if any crime is seen by him.

what prevents the off duty cop to call on duty cop if he finds a crime being committed so that the vehicle is confiscated and offender (the child as well as the vehicle owner) booked heavily?

He can still do so if you rake up the issue.

 

the child should not have driven the vehicle even for one inch.

Even a Normal Man or Women has a right to stop the Crime... EQUAL RESPONSIBILITY to follow the law and to maintain hygiene or a Pledge or oath taken by every individual to respect the law of the country / nation as per Constitution.

No Matter the whether the officer is On Duty or Off Duty he has the right to stop the Child.

He cannot hit them or threaten them but he can file a case against them.

If the Area is not under his Jurisdiction while he is Off Duty he can stop the child to commit offence and can call the Duty Officer from the local police station.

Remember: In this case the Officer in Question is just try to help the Kid and His Family by stopping them to commit any kind of Offence which is against the Law and also minimizing the chances of casualties which can happen while the kid is driving the vehicle. Also, they will have to call to call the parent, legal guardian or NGO who works for the development of child. Also, he need to loop in the Traffic Police in this case for Punishment as per MV Act.

The court has rightly quoted in its judgement as well if you are drunk that doesn't give you a reason to drive the vehicle and put others life in danger. In the same manner in this case if the father is ill it doesn't give the reason to child to commit offense.

No matter which category of offense is being committed. Offense is a Offense.
