Raj Kumar Makkad (Adv P & H High Court Chandigarh)     16 March 2012

Childrens homes under scanning

The Delhi High Court Wednesday refused to quash the Delhi government’s decision to set up a panel to probe allegations of s*xual abuse in three children’s homes in central Delhi.

A division bench of Justice Pradeep Nandrajog and Justice Pratibha Rani dismissed a plea against a government notification ordering the probe and allowed the inquiry against Arya Anathalaya, Arya Bal Grih and Arya Kanya Sadan, all in Daryaganj.

The court noted that all the three institutions were operating from the same complex and their activities were inter-linked.

The Delhi government’s Feb 25 notification was challenged by an NGOs running these institutions.

“We do not highlight the nature of the material available in the file pertaining to the affairs at 1,488 Pataudi House, Daryaganj, for the reason it may unnecessarily cause prejudice, but would record that the material shows a sufficient public interest on a matter of public importance requiring an inquiry into the affairs of the three institutions which are carrying on activities from the said building,” said the court.

There were allegations of s*xual abuse of children at one of the Daryaganj-based children’s home.
