Bonus held by employer

My employer has held my bonus, I have been following up over email/calls but they are not replying back. The reason holding back is that I have resigned from the company and not willing to stay back. There is no policy on record as of date to justify that bonus can be held. In my employment letter, there are no terms & conditions regarding bonus. 

I am documenting everything possible to help in prove in court of law that employer had no intention to pay. At same time, they are paying to other employees who have resigned & have under performed.

Can I file case against employer on same.

Yes you can file a case against the employer as the statutory bonus cannot be withhold unless the Payment of Bonus Act has specifically held for.
