  • The Delhi High court ordered that bulldozer cannot be just brought up at the doorstep. Sufficient time has to be given to the jhuggi jhopri before demolishing the residency.
  • Bringing up a bulldozer straightaway would render them shelter less.
  • The DDA has to act in consultation with the DUSIB for any such venture and no house can have a bulldozer at their doorstep at early mornings or late evenings or at the end of academic years or during monsoons.
  • A reasonable period and a temporary location must be provided to the people. Without a notice the houses cannot be swept.
  • These observations were made by Justice Subromonium Prasad hearing the plea filed by Shakarpur Slum Union stating they consisted of the basti people of Shakarpur district.
  • Last year on 25th June the DDA officials demolished 300 jhopris in that area without any notice.
  • The demolishment lasted for 3 days and some jhuggis couldn’t take their belongings too.
  • The plea was filed to suspend any further demolition and to ask the DDAs to work with status quo not rendering the jhuggis shelter less.
  • Court has asked to rehabilitate these jhuggis and ensure a notice and sufficient time period to be given by the DDAs.
  • The petitioner claimed that the dwellers could be migrants coming from different states and doing odd jobs like rickshaw drivers, domestic workers, etc. Relocating them was the DDAs job. 
  • The demolishment should be carried by the DDAs in consultation with the DUSIB policy. 
  • Unidentified cluster does not mean they are not entitled to rehabilitation.
  • Sufficient time period is essential for the dwellers to collect their documents and belongings or to look for alternative shelters or solutions. 
  • Conclusively the court has held that people considered encroachers cannot be evicted overnight without any notice and temporary location.
