  • The Supreme Court stated that when considering a transfer petition under Section 24 of the Code of Civil Procedure, the wife's convenience must be considered. In this case, the husband petitioned the Family Court in Vellore for annulment of marriage. 
  • The wife filed two petitions in the Family Court in Chennai, one for restitution of conjugal rights under Section 9 of the Hindu Marriage Act, 1955, and the other for maintenance under Section 125 of the Code of Criminal Procedure. 
  • She petitioned the Madras High Court under Section 24 of the Code of Civil Procedure to transfer her husband's petition from the Family Court in Vellore to the Family Court in Chennai.
  • She claimed that her parents are elderly, and that she is 21 years old and unable to travel to Vellore without assistance throughout the court proceedings. 
  • She petitioned the Supreme Court after being dissatisfied with the dismissal of her Transfer Petition. 
  • The court noted that the appellant is 21 years old and has no independent source of income because she is not employed and is completely reliant on her parents for her livelihood. 
  • To attend the court proceedings of her husband's case filed in Vellore, she must travel alone all the way from Chennai to Vellore because her parents are unable to accompany her due to their advanced age, according to bench.
  • The court also stated that it is just and proper to group all three cases together in order to avoid duplication of proceedings and conflicting decisions.
