Medical Practitioners Must Be Protected From Onslaught Of Frivolous Complaints

The Madras High Court has issued a set of guidelines for the National Medical Council. These guidelines are to be included in the new Regulations that are to be framed under the National Medical Council (NMC) Act, 2019 for effective handling of complaints against medical practitioners. The decision was given by Justice R Mahadevan. The name of the case is Dr. P. Basumani v. Tamil Nadu Medical Council.

NDPS Charges Based On Section 67 Statements Of Accused Unsustainable

The name of the case was Sanjeev Chandra Agarwal and Another v. Union of India. The decision in this case was given by Justices Sanjiv Khanna and Bela M Trivedi. In this case, the Supreme Court has set aside the charges framed against the accused after noting that the case was based on statements by the other accused given toofficers under Section 67, which are inadmissible in evidence.

The Supreme Court observed that criminal proceedings under the SC-ST (Prevention of Atrocities) Act are not vitiated merely because the magistrate had taken cognizance and committed the case to the Special Court. The name of the case was Shantaben Bhurabhai Bhuriya v.Anand Athabhai Chaudhari. The decision was given by Justices MR Shah and Aniruddha Bose.
