Madras HC: Cannot Expect Eye Witness Or Independent Witness Since Culprits Exploit Child When Alone

The case was K Ruban v. State. The decision was given by Justice P Velmurugan. He Court stated that conviction of an accused in cases under the Protection of Children from Sexual Offences (POCSO) Act can be based solely on the evidence or testimony of the victim child if such evidence is cogent, consistent, trust worthy and inspires the confidence of the court.

NDPS Act: Are Confessional Statements Given Under Section 67 Admissible In Evidence

A Special NDPS Court has recently rejected the bail application of Aryan Khan. The reason given was that he was in "conscious possession" of the drugs found with Accused No.2- Arbaaz Merchant.The Special judge observed that Khan apparently knew his friend Abaaz Merchant was hiding charas and hence, it would amount to both of them being in conscious possession of the drugs.

SC Explains Distinction Between Preparation and Attempt To Rape

The case was of State of Madhya Pradesh v. Mahendra alias Golu. The decision was given by Justices Surya Kant and HimaKohli. The court observed that these acts were committed with endeavour to commit sexual intercourse. In this case, the SC explained the difference 'preparation' and 'attempt' to commit rape, while upholding the conviction of the man accused.

Offences Under Special Statutes Including SC/ST Act Can Also Be Quashed By Exercising Powers Under S.482 CrPC/Article 142

The case was of Ramawatar v. State of Madhya Pradesh. The decision was given by CJI NV Ramana, Justices Surya Kant and Hima Kohli. The mere fact that the offence is covered under a 'special statute' would not prevent this Court or the High Court, from exercising their respective powers under Article 142 of the Constitution or Section 482 CrPC.
