Default Bail Is An Indefensible Right; It Cannot Be Suspended Even During The Pandemic: Delhi HC

Default bail is a fundamental right which flows from Article 21 of the Constitution and cannot be suspended even during COVID pandemic. The case was of Abhishek v. State. The decision was given by Justice Manoj Kumar Ohri. The Court, therefore, issued a slew of directions so that the rights of undertrial prisoners to seek default bail are not defeated and custody of an undertrial is not extended mechanically.
