Mere Exclusion Of Sibling From Will Not A Ground To Suspect Its Genuineness

The case was of V Prabhakara v. Basavaraj K (Dead) by LR and Another. The decision was given by Justices SK Kaul and MM Sundresh. The Court held that a testamentary court is not a "court of suspicion" but a "court of conscience". Mere exclusion of a sibling per se from the will would not create a suspicion against it, unless it is surrounded by other suspicious circumstances.

Mere Delay In Recording Eye Witness' Statement By Itself Not A Ground To Reject Their Testimonies

The case was of Goutam Joardar v. State of West Bengal. The decision was given by Justices Uday Umesh Lalit, S. Ravindra Bhat and Bela M. Trivedi. The Court held that a delay in recording the statements of eye-witnesses by itself cannot result in rejection of their testimonies. The appeals were dismissed.

Summons To Directors Justified If Complaint Avers That They Were In Charge & Responsible For Conduct If Business Of Company

The case was of Ashutosh Ashok Parasrampuriya and Another v. M/S Gharrkul Industries Pvt Ltd. The decision was given by Justice Ajay Rastogi and Justice Abhay S Oka. It was held by the Court that the summons issued by a Magistrate on a complaint under Section 138 of the Negotiable Instruments Act to the Directors of a Company is justified if the complaint contains the basic averment that they were in charge and responsible for the conduct of the business of the company.

Part Time Employees Can't Seek Regularization As  A Matter Of Right Contrary To Govt's Regularization Policy

The case was of Union of India and Ors.v.Ilmo Devi and Anr. The decision was given by Justices MR Shah and AS Bopanna. The Court decided in this case that part-time temporary employees in a Government-run institution cannot claim parity in salary with regular employees of the Government on the principle of equal pay for equal work.
