SC Tells Centre To Fill Up Vacancies In Central Administrative Tribunal

The Supreme Court has observed that vacancies to the Central Administrative Tribunal had to be filled even if there was a dispute regarding them. The Top Court had directed the Government to "expedite" the appointment of 4 posts to the CAT in accordance with the Tribunal, Appellate Tribunal and Other Authorities (Qualifications, Experience and other Conditions of Service of Members) Rules, 2020.

The case was of Garg Builders v. Bharat Heavy Electricals Limited. The decision was given by Justices S. Abdul Nazeer and Krishna Murari. The court upheld the Delhi High Court judgment and dismissed the appeal. An arbitrator cannot grant pendent lite interest if the contract contains a specific clause which expressly bars payment of interest.
