SC: Every Attempt Has To Be First Made To Revive The Concern And Make It A Going Concern

The Supreme Court has upheld the NCLT order permitting withdrawal of Corporate Insolvency Resolution Process. The Supreme Court has also observed that an adjudicating authority under Insolvency and Bankruptcy Code can allow withdrawal of CIRP proceedings. The case was of K.N. Rajakumar v. V. Nagarajan. The decision was given by Justices L Nageswara Rao, BR Gavai and BV Nagarathna.

Failure Of Accused To Discharge Burden U/S 106 Irrelevant If Prosecution Is Unable To Establish Chain Of Circumstances

It has been observed by the court that failure of an accused to discharge burden under Section 106 of the Evidence Act, 1872 is not relevant in a case governed by circumstantial evidence,if the prosecution is unable to establish a chain of circumstance. The case was of Nagendra Shah v. State of Bihar. The decision was given by Justice Ajay Rastogi and Justice Abhay S Oka.

P&H HC Grants Interim Bail To GurdasMaan Booked For Hurting Religious Sentiments

The case was of GurdasMaan v. State Of Punjab. The decision was given by Justice AvneeshJhingan. The petitioner was a renowned Punjabi singer. A case had been registered against him for his comments which hurt the religious sentiments of the Sikh community. The Punjab and Haryana High Court has granted interim anticipatory bail to the singer.

SC Deprecates Centre's Practice Of Giving Additional Charge To DRT Due To Unfilled Vacancies

The case was of State Bar Council of Madhya Pradesh v. Union of India. The decision was given by a special bench comprising the Chief Justice of India, NV Ramana, Justice DY Chandhrachud and Justice L Nageswara Rao. The court disapproved of the Centre's practice of extending jurisdiction of the Debts Recovery Tribunal of one state to another state due to the unfilled vacancy of the Presiding Officer.
