Bar Under S.9(3) Of Arbitration Act Not Applicable If Application Was Taken Up By Court Before Constitution Of Arbitral Tribunal

The case was of Arcelor Mittal Nippon Steel India Ltd. v. Essar Bulk Terminal Ltd. The decision was given by Justice Indira Banerjee and Justice JK Maheshwari. In this case, it was held that the bar under Section 9(3) of the Arbitration and Conciliation Act operates only when the application under Section 9(1) had not been entertained tillthe constitution of the Arbitral Tribunal.

The Supreme Court has reiterated that a sentence of imprisonment for life means rigorous imprisonment for life. The decision was given by Justice L Nageswara Rao and Justice BR Gavai. The two special leave petitions were disposed of. The case was of Md.Alfaz Ali v. State of Assam.

The case was of Vijaykumar Bhima Dighe v. Union of India and Others and Dr.Mahindra Bhaskar Limaye v. Union of India and Others. The decision was given by a division bench of Justices Sunil Shukre and Anil Kilor. The Court observed that the impugned Rules were an attempt to circumvent the Supreme Court's directions.

SC Dissolves Emotionally Dead Marriage By Invoking Article 142

The case was of Subhransu Sarkar v.Indrani Sarkar (Nee Das). The decision was given by Justice L. Nageswara Rao and Justice BR Gavai. Sr. Advocate Nikhil Nayyar appeared for the appellant, and Advocate Ranjan Mukherjee was the Amicus Curaie. The court held that the marriage was emotionally dead and hence it dissolved the marriage invoking its powers under Article 142 of the Constitution.
