SC Accepts Compensation, Quashes Criminal Case Against Italian Marines In Enrica Lexie Case

The Enrica lexie case deals with a sea firing incident in 2012 near the Kerala coast where two Indian fishermen had been killed. The Supreme Court on Tuesday dropped the criminal proceedings against the two Italian Marines involved, Massimilano Latorre and Salvatore Girone. The compensation of Rupees 10 Crores given by the Republic of Italy was accepted and transferred to the Kerala High Court.

SC States That Taking Custody Of Accused Is For The Investigating Agency To Decide; Is Beyond The HC Jurisdiction

The Supreme Court observed that it is up to the investigating agency to decide whether to arrest the accused or not. Taking the accused into custody was beyond the jurisdiction of the High Court. The Bench gave a decision while considering a Special Leave Petition against a High Court order that quashed the anticipatory bail granted to the accused.

Delhi HC Upholds Order For Registering FIR For Caste Based Questions In DSSSB Recruitment Exam

The Delhi High Court upheld an order passed by a Trial Court to initiate the registration of a FIR under the Scheduled Caste and Scheduled Tribe (Prevention of Atrocities) Act, 1989. This was done because the questions asked in the Delhi Subordinate Services Selection Board examination were prima facie insulting to members of certain castes. Whether the DSSSB was aware about the nature of the questions was to be ascertained through investigation.

PIL For Action Against Alleged Police Atrocities In Lockdown Dismissed By Karnataka HC

The PIL filed by advocates to register an FIR against certain Station House Officers who allegedly tortured lockdown offenders has been dismissed by the Karnataka High Court and the petition has been termed frivolous and unsubstantiated. The Court has also imposed a cost of Rupees One Thousand which is to be deposited with the Karnataka Legal Services Authority.

Narada Case: Police Custody Not Permissible After Chargesheet Is Submitted, says Sr. Adv. Siddharth Luthra

In the ongoing Narada Case which is being heard by a 5 judge Bench, Senior Advocate Siddharth Kuthra, who was appearing on behalf of the four arrested Trinamool Congress leaders, contended that once the investigation is complete and the chargesheet has been filed, the question of custody and remand cannot arise. The case of KK Girdhar V. MS Kathuria was referred to. 

What do you think about the case?

Bombay HC: Door-To-Door COVID Vaccination May Be Implemented If States Permit

The Bombay High Court stated that there was no provision imposed by the Central Government that would prohibit the States from carrying out door-to-door COVID 19 vaccination for the elderly and the disabled. The Bench also stated that the same can be implemented immediately. The States and UTs had been advised to implement the Near to Home COVID Vaccination Centres (NHCVCs).
