Overview

  • On the 7th of May 2021, Mr. Mohit D. Ram, the Standing Counsel of the Election Commission of India resigned stating that his values are not in consonance with the current working of the Election Commission of India.

What Was The Reason Given For Resigning

  • In his letter of resignation, Mr. Mohit D. Ram said that It was an honour for him to represent the Election Commission of India and he had a cherishing milestone of his career, in the journey which begins with him being a part of the Office of Standing Counsel of Election Commission of India and progressed as one of the Panel counsels of Election Commission of India since 2013.
  • He also submitted that he has found that his values do not align with the current working of the Election Commission of India and thereby he resigns before the Honorable Supreme Court from the responsibilities of the Panel Counsel of the Election Commission of India.

Facts Of The Case That Was Represented Before The Court

  • The Madras High Court has orally remarked that the murder charges should be initiated against the officials of the Election Commission of India but this was not penned down. However, the media-hyped up this remark and published it.
  • This resulted in negative thoughts for the ECI in the minds of people and several complaints were also registered after this.
  • The Election Commission of India filed an appeal in Madras High Court requesting the Court to refrain the media from publishing the oral remarks.
  • The plea was dismissed by the Madras High Court.
  • After the Madras High Court dismissed the Pleas, the Election Commission of India approached the Honorable Supreme Court regarding the same issue.
  • The Honorable Supreme Court also dismissed the plea of the Election Commission of India.
