OVERVIEW

  • Recently, A Draft Model Standing Orders for Service Sector, Manufacturing Sector and Mines has been published by Ministry of Labour and Employment.
  • The main draft Model for Service Sector now includes Work from Home Option.
  • It says that, according to conditions of appointment or agreement between employer and employee, employer may allow an employee to work from home for a period determined by employer.
  • Three hundred plus workers who are working in the industrial establishments employees which are covered under the Occupational Safety, Health and Working Conditions Code, 2020 and the rules made thereunder under the control of Central Government or the State Government will be employed.
  • Andlater, these Orders will extend to all States and Union territories within India to the industrial establishments

SUGGESTIONS INVITED

  • Incredibly, the Ministry has also invited objections and suggestions this time, from the persons affected.
  • The suggestions and objections will be entertained for thirty days only.
  • Central Government to model standing orders relating to conditions of service and other matters incidental to that or connected therewith, which is empowered by Section 29 of the Industrial Relations Code, 2020.
  • In respect with the matters specified in the First Schedule, the standing orders needs to be drafted by the employers andwould be based on these model standing orders.

MATTERS SPECIFIED UNDER FIRST SCHEDULE

1. Arrangement of workers, such as permanent, temporary, apprentices, probationers, badlis or fixed term employment.

2. Method of indicating to workers periods and hours of work, holidays, pay-days and wage rates.

3. Shift working.

4. Attendance and late coming.

5. Conditions such as procedure in applying and the authority which may grant leave and holidays.

6. Obligation to enter premises by certain gates, and liability to search.

8. Termination of employment, and the notice therefrom to be given by employer and workers.

9. Suspension or dismissal for misconduct and acts or omissions which establish misconduct.

10. Means of redress for workers against unfair treatment or wrongful work demands by the employer or his agents.
