THE KARNATAKA HIGH COURT DIRECTED A COP TO CLEAN THE PUBLIC ROAD INFRONT OF THE POLICE STATION AS A COMMUNITY SERVICE AFTER HE FAILED TO REGISTER AN FIR.

• Tarabai W/o Heerasing Rathod v. The State of Karnataka (WRIT PETITION HABEAS CORPUS NO.200012/2020).

• A house officer of the Kalaburagi Police Station was approached by the Petitioner Tarabai for registering a complaint against the abduction of her son.

• The house officer, despite knowing that the offence was cognizable under IPC, refused to register an FIR.

• The Petitioner then approached the High Court with a writ of Habeas Corpus for her son.

• The Division bench comprising of Justice S Sunil Dutt Yadav and Justice P Krishna Bhat took the matter seriously and rebuked the police station for failing to perform its duties.

• However, on request of the Advocate for Respondent, the court took a lenient approach in the and instead of punishing the house officer, the court accepted an undertaking submitted by him through the advocate.

• In the undertaking, the cop had apologized for his conduct and gave assurance that it wouldn’t be repeated.

• In the undertaking, he also assured that as a community service, he will be cleaning the public road in front the police station for the whole week.
