Sirohi District Bar Association through its member Ashwin Mardia, the Petitioner, has filed a  a PIL, after a representation was made to the Registrar Generals of the Rajasthan High Courts at Jaipur and Jodhpur on 12th February, which yielded no positive result. The PIL is regarding the failure to give timely notice of leave taken by Learned Judicial Officers causing hardship to Advocates as well as litigants. The petition represented all the advocates practising and appearing regularly before the various Learned Judicial Officers in the district of Sirohi, Rajasthan.

What is the Issue?

• As hundred of litigants, thousand of witnesses travel long distance to attend court proceedings everyday, they should be aware about the leave of the Judicial Officers.

• On the official website of the district courts, there is a section which is meant to update the information regarding absence/ leave of the judicial officers. Most of the individuals check the official website of the courts i.e. https://districts.ecourts.gov.in/sirohi to ensure that the Learned Judge before whom their case is listed does not have his name on the ‘Judicial on Leave’ section for the particular day.

• However, the information is not updated mostly, if uploaded is often put at a belated stage thereby frustrating the very purpose for seeking such timely information.

• If the Hon’ble Judges of the High Court duly intimate the registry well in advance, so that the advocates, litigants and the witnesses are well informed about the leave, the very same should be uploaded on the website within time.

It was prayed in the petition that, the information regarding leave of the Learned Judicial Officers should be uploaded on the website atleast one day prior in order to minimize the hardships caused to advocates, litigants as well as the witnesses.
