The High Court of Karnataka at Bengaluru issues a press note on July 4, 2020 where it has informed about a unique initiative of establishment of a Remand Court atGurunanak Bhavan, Vansathnagar, Bengaluru.

The Remand Court has been set up in adherence with the COVID-19 guidelines issued by the Central and State Government. It is specially designed with transparent partitions for the physical production of arrested persons and undertrial prisoners for the purposes of remand or bail.

The Chief Metropolitan Magistrate/ Additional Chief Metropolitan Magistrate/ Metropolitan Magistrate designated for physical examination of arrested person or undertrial prisoners will hold sitting in the Remand Court and take physical production with all possible safety measures.

“This will facilitate safe production of arrested persons and under trial prisoners in compliance with the COVID-19 guidelines issued by the Government Authorities.”, the Bench asserted in the Press note.

Recently, problems have arose regarding the physical examination of arrested persons/ undertrial prisoners by Magistrates since social distancing norms have to be followed and the spread of Coronavirus has to be contained. The person to be examined is held at a distance from the Magistrate due to which it becomes difficult for the concerned Magistrate to accurately examine the physical condition of the person and pass appropriate order for remand or bail in that regard.

The Bench led by Chief Justice Abhay Oka, had previously suggested the setting up of a public hall outside the court premises to prevent taking the arrested persons to regular court complexes and hence restrain the spread of the virus.
