A new law regarding Organ Donation has commenced its operation in England on 20 May 2020, after years of campaigning. The Law is namedin honor of two inspiring kids –Max Johnson, who survived heart failure by receiving Keira Ball’s heart. This 9-year-old girl died at a car crash in 2017 and her organ donations saved the lives of four. After this, their families campaignedfor an ‘opt-out’ organ donation scheme, which received Royal Assent on 15 March 2019. 

The earlier system provided that only those who opted in could donate organs after death. Very few people used to sign up in the NHS Organ Donation Register, even though a great majority would want to help people in need. The new Max and Keira’s Law sets forth a tremendous change as it presumes that every adult who dies has consented to donate his organs to those awaiting transplant surgeries. People have to ‘opt-out’ of this scheme in the NHS Register if they do not wish to donate. Children, lunatics, people who have not lived in England for more than 12 months, people belonging to groups that do not allow organ donations etc. are excluded from this involuntaryopt-in system.

The Max and Keira’s law is regarded as a milestone in England’s health sector, since it is expected to remove a lot of myths and taboos existing in relation to organ donation. Deemed consent has become the norm and choosing out of it is the exception. The lawmakers believe that this change will have a positive impact on hundreds of patients every year.
