MP HC: Contempt notice against Govt. for illegal constructio

The Madhya Pradesh High Court has issued contempt notices to the state government and three directors of a construction company on a petition challenging the government’s failure to take action against illegal construction of a five-storeyed hotel on the green belt of Ganesh nagar colony in Babaria Kala.

A division bench comprising Justices Deepak Mishra and Satish Chandra Sharma issued the notice on a petition by social worker Devendra Prasad Mishra. He contended that the construction of the hotel and commercial complex was illegal as Ganesh nagar fell under a green belt site as per the orders of the High court in 2006.

Petitioner’s counsel Dinesh Upadhyay said Girija Developers and Surendra Builders had constructed the building despite the court’s stay on its construction. The order on February 13 restrained directors of Girija Developers and Surendra Builders, Arun Malhotra, Adarsh Malhotra and Vikas Malhotra from carrying out further construction at the site.

The petitioner said the builders had earlier filed a petition before the court for vacating the stay as they had already completed the construction after securing the government’s permission.
