What is the Procedure for Register a Unregistered WILL?

Respected Members:

Can you please provide me the procedure for registering a unregistered WILL. Please note that the testator WILL had already died 2 years ago. Your valuable response on the following questions shall be appreciated:

1. Procedure for registering a unregistered WILL;

2. Procedue for mutuation of a property with respect to above case?

Your early response shall be highly appreciated.

Well Navin Arya, legally the registration of the will is not mandatory, it is optional, however in ur case the testor already died hence question of registering the will does not arise and regarding the transfer of property through will to beneficiaries through court procedure, is different from state to state.

you have to file a probate Original Petition and the same can be filed under the Indian Succession Act..

in absence of the testetor registration of will is not possible, either you have to apply for the probate or go for declaration suit.
