Society re-formation when de-registered

Hi,

We have a Bldg with OC in 2003 but a Society was formed in 2007 since the builder did not allow to form society. only 20 % Flats were sold during this period. The residence went ahead and formed the society but the consultant submitted all wrong information to Registrar and formed the society. After 2009 most of the flats were sold, Now the builder filed a complaint with the Registrar and now the Society is deregister u/s 152. The builder is troubling all the Flat owner for maintenance till today and threatening criminal action against us.

Can somebody guide on what should be the next action... either to file a new Society without Builder coorperation or Appeal to coorperative ministry. Any other path available so that we can correct the documents for existing society and resubmit since there is a majority of 90% Flat owners now.

The Builder is making life miserable by threatning and doing illegal construction in the absence of a society.
