where to put application u/s. 390 crpc

respected sir,

my appeal u/s.378 got admitted but the accused remain absent Hon'ble Bombay High court passed an order of appeal admitted but not directed the accused to present also not gave any direction for presence of accused my question is can i press fresh misc application U/s. 390 to Hon'ble High Court or JMFC, Mumbai  from where the accused got acquitted complaint u/s. 138 N. I Act.
