Transfer of property During probate petition pending

When probate petition is pending defendant have transfered property in their name. Can they do that? its done based on false affidavit stating no court case is pending in any of the court.

You must give more particulars. Who was the owner of the property. Who executed the will. who are the plaitniff and who are the defendants. When the will is pending probate, by what mode the property was transferred by the defendants. etc

Dear Karemblekar,

If the defendant sold the property by showing a false affidavit than definitely he is liable for prosecuton and  punishment during pendency of any proceeding.
