Trademark

Hello All!

 

I want to know that when a company applies for a trademark in TM-1, the application is signed by an authorised signatory, so is there a need of any board minutes to be attached or some other authority letter to be attached for such signature along with the TM-1 and the Additional Representations?

Dear Vaibhav,

If some one applying on behalf of company they have to produce all the relevant documents before the registrar to support the authority.

Formalities or Documents required for trademark registration are

logo or brand name or wordamrk

class to be registered

TM Application form

TM Authorization or Power of Attorney (to be signed by Company directors )

Usually there is no need to submit minutes of meeting. It is a rare scenario

If the Applicant is Legal Person (Company, Partnership firm, Association etc.,) there should be Authroization through General Power of Attorney.

This Power of Attorney/ Authorisation must be in whose favour? Can anyone provide with a format? We are a company and are not going through a TM Agent. Do we still need a authorisation?

No such additional representation may be needed at the time of filing TM 1.

If it is a company then the company may directly approach the TM authorities for registration.
