Stamp Duty of Deed of Partition

Hello,

My Father Purchased a property (2 adjoining shops) in the joint name of My father and my uncle which had a single agreement. My father passed away 3 years back and my mother has become the legal heir of the property. Following a dispute with the other party, we had mutuallly agreed to part our ways and seperate the property by building a wall in between the property. We had also agreed to seperate the legal documents so that there will be no conflict in the future. It had come to my knowledge that stamp duty had to be paid again for registering the deed of partition,

 

Pls advise me whether stamp duty has to be paid again for the same property when we had already paid the stamp duty. I think this is leading to double payment of the stamp duty as in practicality no sale is taking place and the transaction is a mere transaction on paper.
