Salary not paid

Dear Sir/Madam,

 

                                   This is Allaudeen working online to me medical transcripttion company.  the office is located in Pune, first 2 months they payed and after two months working continuously they told to stop work and they did not pay two months salary and they are nogotiating.  Please give me a suggestion.

Sir,

        Online work they are providing any appointment letter, before also I work this company for 6 months from june to december of 2010 and they payed correctly and they told to stop, so I stopped. That time, they are again told me to work, and I work from july, august, september and october.  July and august salary I got and september and october months salary not got, telling they did not get money from the client. I have the chatting messages with me thats it.. please provide me suggestion..

          They are not provided any appointment letter since it is online work, so through chattings only the work is going on. please provide me any idea to tackle this problem.

Learned Mr. Nadeem has given valuable advice. Kindly follow it.

It seems that at the most it can be job work, project work. However there is no specific contract.

It is felt that there is nothing on record e.g. offer letter, appointment letter.

You may supply a written notice (which you can also send) to supply you the payment within say......7 days.

If you have decided not to entertain any job work in future from them, you can take a printout out of all chatting messages and approach your lawyer.

Legal notice from your lawyer may work. To avoid contracting a lawyer at your location, attending to courts etc, suffering expenses, company feel that paying you shall be better option. If nothing works, you may have to move competent court of law. You can also visit local o/o Labor commissioner and meet the wages/labor inspector and obtain their qualified advice.

Company's logic that the principle company has not paid them shall not work.

if you work online jobs without any written contract, then it is difficult to prove that you have a work contract  in the court of law.  But if you have circumstancial evidence, such covering letter while giving job and any correspondence and bank payment, then you file case against him.

SEE WHAT MATTER YOYU GOT IN THAT EMAIL MAY BE SUBSTANTIAL IN PROVING THAT A AGREEMENT WAS THERE.......... IT WILL BE GOOD IF YOU POST SOME OF THOSE MESSAGES........ THEN ONLY THE MATTER CAN BE CLEAR.......

EMAILS ARE AS GOOD AS WRITTEN DOCUMENTS IN PRESENT DAY LAW. ANY EMAIL IS EVIDENTIAL AS AGREEMENT/CONTRACT.

@Allahudin: Sue them on the basis of chat transcriptts email communications etc. If they didn't email you the chat trascriptts that's more trouble for the. Get hold of good advocate.

Consult    A   Good   Advocate   Localy  &   file   A   case    against the   Company  Manager,  who  has   paid   You  appointment  or   salary   in  the   past.  Have   faith  in  GOD.......everything  will   be   alright..

Dear all,

 

                     Thank you very much for all of yours opinion and valuable suggestion, today also I called and they told next week if money comes from cilent, they will pay, again he postponed to next week, so I will wait upto this month last week, if he is not going to give then I wil take suitable step with all of yours opinion.

It shall be appropriate to send email/letter post your telephonic discussion.

It is felt that you should record the telephonic conversation also.

Kindly proceed as deemed fit.
