Revoke a Normal Gift Deed

 

Property Type:   Agriculture Land in Prodduttor, Kadapa, Andra Pradesh

 

Property Registered as:  GIFT DEED

 

Property Registered date:   28-12-2005

 

Property Donor:   Uncle to Donee   

 

Property Donee:   Daughter- in- Law  to Donor

 

Property Registration:  registered with Sub-registrar Prodduttor AP and

paid stamp duty charges of 6% and registration charges in 28-12-2005

its not a conditional/onerous gift deed

its a normal Gift deed

Can donor revoke a normal Gift deed through sub registrar/registering authority after 5 years

Or registrar/registering authority, have the powers to cancel or revoke the normal Gift deed

 In favor of donor back, after 5 years

Dear Satish

 

Sub registrar has only powers to register documents as per the provisions of the registration act.               Sub Registrar has no powers to cancel / revoke any registered document.  Once a document is registered, sub registrar loses power to modify or revoke or cancel it.   Only civil courts have powers to pass orders in respect of such issues.

1.  A Registered Gift Deed cannot be revoked under any circumstances, if the gifted property has changed hands from the Donor to the Donee.


2.  If the gifted property, is in itself is bad in law,  the gift deed is automatically null & void.


3.  HOWEVER,   by mutual consent of the Donor and the Donee, a Gift Deed can be revoked by a seperate registered deed, subject to few legal parameters.

Please clarify how the gift deed could be revoked mutually by the doner and the donee.
