RELEAVING AFTER NOTICE PERIOD

Dear Experts,

One employee is resiged the management has issued a relieving order as stating in the appointment order one month notice. He is suppose to be relieved immediately after thirty days, but by over look or forgotten. He is continuing and after seven days of expiring of the notice period datehe is approached to the HR department for relieving formalties. In this juncture what statutory things we have to observe.?

I think the requirement is for minimum 30 days notice, if period exceeds to notice period, nothing is wrong.The employee should not be forced to give againg 30 days notice.

Dear Mr. Kumar,

As said by Mr. Sharma, there is nothing to worry.  It is like extension of notice period. While giving the relieving order, you have to ensure, that extended days are covered under the service period and proper compensation dues are taken care.

Whether your employer has accepted your resignation. In case, your resignation is accepted, your employer is bound to give reliving letter provided the condition of bond are fulfilled. You can give notice to your employer to issue reliving order.In case, after notice the same is not provided you are free to take legal recourse,
