Dear Satish,

Ofcourse, he can claim depends on the terms and policy conditions of the insurance. However, whether the accident occured due to the negligent driving of the driver/owner (Properietor) i.e., is it a self-driven-vehicle injury without the involvement of the other vehicle or the other vehicle hit the (proprietory firm's) vehicle should be answered first.

regards,

Dear Satish, He can only claim P.A. because he is not a third party. Owner of vehicle may  not claim for his injuries sustained  by him in an accident.

Thanks
