Hello,

I am new to this site and do not know the right forum to post this question.  I have a friend who is mentioned in a FIR against another party (FIR was filed by a third party).   She is willing to extend full co-operation to the investigation; however she is not in the country at this time.   Are there are alternative ways to provide the information to the Investigating Officer without having to make a trip back?  If the cops are willing to wait for her return or visit her at the present location, then it is not a problem.  To avoid delaying the investigation, can she provide her statement through her lawyer?   I understand that since she is not a material witness, alternatives do exist.

Dear Ms.Jyothi,

As evident from your mail under reply whatever statement your friend wishes to make to the investigation officer could be by way of e mail/fax or even by post as well.

Thank you for the confirmation.  Is that applicable to all states in the country or is it at the discretion of the IO?  Also, if the cops deem that one is a material witness what options are available?

Ms.Jyothi,

As it is evident from your mail if in case your friend by any means is ready and willing to extend all possible help then in his turn the Investigation Officer should also see that she should not be bothered unnecessarily as such in the fitness of things he should and must consider other viable options for proceedings with the investigation.

If the IO feels that she is a material witness then probably she can appear in video conference and submit her contention

hiii

first of all whether ur friend got any legal process or not....if yes she can send her statement in written with her endorsement. This one is a criminal case so the personal appearence is required but if the witness is material one. The IO or court can dispense her personal appearence if the facts and circumstances of the case so.

so to get clear answer u should clarify what the role of your friend in the related case.
